Terms of Service

1. Agreement & Scope

By accessing or utilizing QSmartExam, you agree to these Terms of Service. Where an institution has executed a custom Master Services Agreement (MSA) or formal Order Form, the provisions of that agreement shall prevail in case of any inconsistency.

2. Accounts, Authentication & Governance

Institutions are responsible for provisioning faculty and candidate accounts, enforcing role-based permissions, and revoking credentials upon graduation or separation. Multi-factor authentication (MFA) is strongly recommended for all proctor and evaluator roles.

3. Acceptable Use & Academic Integrity

All users must uphold rigorous academic integrity standards. Prohibited activities include:

• Any attempt to circumvent or tamper with AI proctoring, secure browser lockdown, or automated event logging.
• Uploading unlawful, copyrighted, defamatory, or malicious material into institutional question banks.
• Unauthorized vulnerability scanning, automated scraping, or reverse engineering of the platform.
• Impersonation of examinees or falsification of exam results and identity credentials.

4. Institutional Content & Intellectual Property

All examination questions, blueprints, candidate answer scripts, and proprietary grading rubrics remain the exclusive intellectual property of the subscribing institution. QSmartExam processes this data strictly as a processor pursuant to our Privacy Policy.

5. AI-Assisted Outputs & Faculty Supervision

AI-assisted features (including automated paper drafting, question suggestion, and subjective answer grading) serve as academic decision-support tools. Final validation, grade assignment, and student feedback remain under faculty supervision and discretion.

6. Availability, SLA & Support

We commit to enterprise-grade system availability (99.9% uptime target) and provide advance notification for scheduled maintenance. Growth and Enterprise tiers include dedicated technical support and service-level commitments.

7. Subscription Fees & Billing

Pricing, volume tiering, and billing cycles are defined in the institution's active Order Form. For refund and cancellation policies, please review our Refund & Cancellation Policy.

8. Suspension & Data Portability

We reserve the right to suspend accounts engaged in gross breaches of security or exam integrity. Upon subscription termination, institutions retain 30 days of full data portability to export historical exam records and candidate score archives.

9. Limitation of Liability

To the maximum extent permitted by applicable law, aggregate liability is limited to fees paid in the twelve months preceding any claim.
