Terms of service
Last updated: 1 January 2026. These terms apply to every QSmartExam subscription.
1. Agreement
By accessing QSmartExam you agree to these terms. Where an institution has signed a separate order form or master agreement, that agreement prevails in case of conflict.
2. Accounts and access
Institutions are responsible for provisioning accounts, assigning roles and revoking access promptly. Credentials must not be shared. Two-factor authentication is strongly recommended for administrative roles.
3. Acceptable use
- No attempt to bypass proctoring, lockdown or access controls.
- No uploading of unlawful, infringing or malicious content.
- No load testing, scraping or reverse engineering without written consent.
- No use of the platform to impersonate a candidate or falsify results.
4. Institutional content
Questions, papers, candidate responses and results remain the property of the institution. We process this content solely to provide the service and to meet the institution's instructions.
5. AI-assisted outputs
AI-generated questions, papers and evaluations are decision-support tools. Institutions must review outputs before they are used for grading, certification or any high-stakes decision.
6. Availability
We target high availability and publish planned maintenance in advance. Enterprise plans may include contractual service levels and support response times.
7. Fees
Fees, billing cycle and student volume are defined in the order form. Overages are billed against the next cycle unless otherwise agreed.
8. Suspension and termination
We may suspend access for non-payment or for conduct that threatens platform security or exam integrity. On termination, institutions may export their data for 30 days.
9. Liability
To the maximum extent permitted by law, liability is limited to the fees paid in the twelve months preceding the claim. We are not liable for indirect or consequential loss.
